National Park Poultry Farming Decree Annulled

The Constitutional Chamber of Costa Rica’s Supreme Court (Sala IV) ruled on Thursday that a 2001 executive decree that expanded the Guaymí indigenous reserve to allow the community to establish a poultry farm at the expense of Corcovado National Park in the country’s southern zone is unconstitutional.

The resolution is in lawsuit that claimed that the decree impinged on the area and allowable uses of the park, which was created by law and which is state property.

A man with the last names of Bonilla Villalobos, who filed the action, claimed that the decree “produced an illegal impact on the public domain.”

The high court ruled in favor of Villalobos’ claim and gave the Guaymí one year to cease using the area granted to them by the decree.
